The test of whether an employer is in breach of the implied term of trust and confidence is a purely objective test. It is not the same as, and does not necessarily incorporate, a band of reasonable responses test – although the reasonableness of the employer’s conduct may, in some cases, be one of the tools used in deciding whether there was a fundamental breach.
