The EAT upheld the tribunal’s decision that the Claimant had not resigned, despite the fact that she had handed in a letter stating “Please accept one month’s notice from the above date”. The giving of “notice”, here, had to be understood in the context of the fact that the Claimant had been offered another job within the Trust. It was, thus, not an unambiguous resignation. The special circumstances of this case made it unreasonable to construe the words as the Claimant giving notice of the termination of her employment.
