Mr R Simpson v Secretary of State for Justice UKEAT/0274/17

The EAT held that where a tribunal is assessing whether an employer failed to make reasonable adjustments in offering an employee an alternative role, it is relevant to the tribunal to consider whether the position being offered was likely to exacerbate the Claimant’s stress (the substantial disadvantage of which he complained) and whether there was another role available that did not have that effect.
